In Virginia, there are two types of divorce: no-fault and fault divorce. A fault divorce is one you can petition for when the other spouse has engaged in certain conduct that allows you to file.
For example, a fault divorce can be filed if the other spouse has had a relationship outside the marriage, abandoned you, caused you physical or serious emotional harm, or has been convicted of a felony and sentenced to a jail term of one year or more.
One of the key differences with a fault divorce is that you can file right away, without the waiting period required for a no-fault divorce, which can be six months or a year, depending on the circumstances.
